These Terms of Use form an agreement between you and Aivelt Studio, operated by Ferdi Bayrak ("Aivelt Studio," "we," "our," or "us"). They supplement Apple's Standard End User License Agreement.
1. Acceptance of Terms
By downloading, accessing, or using Your X Wallpapers (the "App"), you agree to these terms. If you do not agree, do not use the App.
2. Limited Use License
We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the App on Apple devices you own or control, subject to these terms and the App Store rules. You may not copy, sell, rent, reverse engineer, interfere with, or misuse the App except where applicable law expressly permits it.
3. Your Photos and Creations
You retain ownership of photos and other material you select when using wallpaper creation tools. You are responsible for having the rights needed to use that material and for ensuring your creations do not violate intellectual-property, privacy, or other rights. We do not claim ownership of your creations.
4. App Content and Intellectual Property
The App, its design, software, branding, included wallpapers, and other supplied material are owned by or licensed to Aivelt Studio and are protected by applicable intellectual-property laws. App content is licensed for personal wallpaper use and may not be redistributed or sold as a standalone product.
5. Subscriptions and Purchases
The App may offer auto-renewing monthly or annual subscriptions and other in-app purchases.
- Payment: Apple charges your Apple Account when you confirm a purchase.
- Renewal: A subscription renews automatically unless you turn off auto-renewal at least 24 hours before the current period ends.
- Management: You can manage or cancel subscriptions in your Apple Account settings.
- Refunds: Apple handles billing and refund requests under its policies and applicable law.
6. Advertising and Third-Party Services
The App may display advertising or use third-party services for purchases, analytics, diagnostics, or app functionality. Those services may be governed by their own terms and privacy policies. Our Privacy Policy explains the relevant data practices.
7. Availability and Changes
Wallpaper availability, features, compatibility, and pricing may change. We may update, suspend, or discontinue all or part of the App when reasonably necessary, subject to applicable law.
8. Disclaimer
The App is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that every wallpaper or visual effect will appear identically on every device or iOS version.
9. Limitation of Liability
To the maximum extent permitted by law, Aivelt Studio will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Mandatory consumer rights that cannot legally be excluded remain unaffected.
10. Termination and Governing Law
We may terminate this license if you materially breach these terms. These terms are governed by the laws of Turkey, without limiting any mandatory protections available in your country of residence.
