These Terms of Use form an agreement between the adult accepting them and Aivelt Studio, operated by Ferdi Bayrak ("Aivelt Studio," "we," "our," or "us"). They supplement Apple's Standard End User License Agreement.
1. Acceptance of Terms
By downloading, accessing, purchasing through, or allowing a child to use Baby Kids Tube (the "App"), you agree to these terms. If you do not agree, do not use the App.
2. Parent or Guardian Responsibility
The App is designed for young children to use with appropriate adult involvement. The parent or guardian is responsible for device settings, screen-time decisions, purchase approval, internet access, and supervising the child's use. Parental gates reduce accidental access but are not a substitute for adult supervision.
3. Limited Use License
We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the App on Apple devices you own or control, subject to these terms and App Store rules. You may not copy, sell, rent, reverse engineer, interfere with, bypass parental controls in, or misuse the App except where law permits.
4. Content and Educational Disclaimer
The App provides curated entertainment and learning-oriented media. It is not professional medical, psychological, educational, or developmental advice and does not promise a particular learning outcome. Content availability may change because of licensing, technical, regional, or editorial requirements.
5. Subscriptions and Purchases
Optional premium access may be offered through an auto-renewing subscription or other in-app purchase.
- Adult approval: Purchases should be initiated and approved only by a parent or guardian.
- Payment: Apple charges the purchaser's Apple Account at confirmation.
- Renewal: A subscription renews automatically unless auto-renewal is disabled at least 24 hours before the current period ends.
- Management: Subscriptions can be managed or cancelled in Apple Account settings.
- Refunds: Apple handles billing and refund requests under its policies and applicable law.
6. Intellectual Property
The App, its software, design, branding, and supplied material are owned by or licensed to Aivelt Studio and are protected by applicable intellectual-property laws. Media made available through the App remains the property of its respective rights holders and is provided for personal viewing only.
7. Availability and Changes
We may update, replace, remove, suspend, or discontinue features or content when reasonably necessary. We do not guarantee uninterrupted access or compatibility with every device, network, or operating-system version.
8. Disclaimer
The App is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, Aivelt Studio will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the App. Mandatory consumer rights that cannot legally be excluded remain unaffected.
10. Termination and Governing Law
We may terminate this license if these terms are materially breached. These terms are governed by the laws of Turkey, without limiting mandatory protections available in your country of residence.
